These Terms of Service ("Terms") govern your use of the Neura Analytics platform and services provided by Global Link Tvl Inc., a Delaware corporation ("Company," "we," "us," or "our").

By accessing or using our AI-powered marketing analytics platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access our services.

2. Description of Services

Neura Analytics provides an AI-powered marketing intelligence platform that offers:

• Multi-touch attribution modeling using proprietary AI algorithms
• Real-time marketing analytics with sub-second data processing
• Machine learning-powered predictive insights and recommendations
• Natural language processing (NLP) for sentiment analysis
• Computer vision capabilities for creative performance analysis
• Automated anomaly detection and alert systems
• Integration with 100+ marketing platforms via native connectors
• Custom reporting with white-label options for agencies
• RESTful API and GraphQL access for enterprise customers
• Webhook support for real-time event streaming
• Data warehouse integration (BigQuery, Snowflake, Redshift)
• GDPR and CCPA compliant data processing

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Account Registration

To use our services, you must:

• Create an account with accurate and complete information
• Be at least 18 years old or the legal age in your jurisdiction
• Have the authority to enter into these Terms
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Intellectual Property Rights

Our Intellectual Property

All content, features, and functionality of our services, including but not limited to software, text, graphics, logos, and AI models, are owned by Global Link Tvl Inc. and protected by intellectual property laws.

Your Content

You retain ownership of any data you upload to our platform. By using our services, you grant us a license to use, process, and analyze your data to provide and improve our services.

Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution to you.

6. Payment Terms

Subscription Plans

Our services are offered through the following subscription tiers:

• Starter: $299/month - Up to 10,000 events
• Professional: $799/month - Up to 100,000 events
• Enterprise: Custom pricing - Unlimited events

By selecting a plan, you agree to pay the associated fees. Overage charges apply at $0.01 per additional event.

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We may change pricing with 30 days' notice
• You are responsible for all applicable taxes

Free Trial

If we offer a free trial, it will automatically convert to a paid subscription unless cancelled before the trial period ends.

7. Data Processing and Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to our collection and use of data as described in the Privacy Policy.

We process marketing data using AI and machine learning technologies to provide insights and recommendations. You are responsible for ensuring you have the necessary rights to share data with us.

8. Service Level Agreement

We strive to maintain high availability of our services:

• Starter Plan: 99.5% uptime SLA, 48-hour support response
• Professional Plan: 99.9% uptime SLA, 24-hour support response
• Enterprise Plan: 99.99% uptime SLA, 1-hour support response
• Scheduled maintenance: Second Tuesday of each month, 2-4 AM PST
• Emergency maintenance: Maximum 4 hours per quarter with notice
• Service credits: 10% for each 1% below SLA threshold
• Real-time status page: status.globallinktvi.com
• API rate limits: 100/min (Starter), 1000/min (Pro), unlimited (Enterprise)

Service credits may be available for Enterprise customers subject to separate agreements.

9. Disclaimers and Limitations

No Warranty

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Limitations and Responsibilities

Our AI-generated insights and predictions are based on statistical models and machine learning algorithms. Users acknowledge that:

• AI predictions are probabilistic and not guarantees of future outcomes
• Model accuracy depends on data quality and quantity provided
• Results may contain biases present in training or input data
• Human oversight is recommended for critical business decisions
• We continuously update models but cannot guarantee specific accuracy rates
• Historical performance does not guarantee future results
• AI recommendations should be validated against business expertise

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOBAL LINK TVL INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF $100 OR THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.

10. Indemnification

You agree to indemnify, defend, and hold harmless Global Link Tvl Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services or violation of these Terms.

11. Termination

Either party may terminate these Terms:

• By providing 30 days' written notice
• Immediately for material breach that remains uncured after notice
• Immediately if required by law

Upon termination, your access to our services will cease, and you must stop using our services. Provisions that should survive termination will remain in effect.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California, unless both parties agree to another location.

The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions, class arbitrations, or representative actions.

Exceptions: Small claims court actions and injunctive relief for intellectual property violations are excluded from arbitration.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or through our platform. Continued use of our services after changes constitutes acceptance of the modified Terms.
